Roger Smith is highly experienced in all areas of serious crime, acting both for prosecution and defence.
He has argued points of law, (both substantive and adjectival), in the appellate courts in many leading cases, including appearances in the House of Lords in Gumbley v Cunningham (1988) 1 A.C. 281 and R v Hinks (2001) Crim.L.R.162.
He has appeared in many important cases involving criminal procedure in the Divisional Court including DPP v Dudley ex p. Gillard (1986) A.C. 442 which went to the House of Lords.
Environmental Law
Roger Smith argued the case for the respondent in Wychavon District Council v National Rivers Authority (1993) 1 W.L.R.125 and for the appellant in National Rivers Authority v Wright Engineering Co. Ltd (1994) 4 All E.R. 281 The argument was finally accepted by the House of Lords in the Empress Car case.
